Individual consultancy assignment: International Consultancy on drafting of recommendations for the improvement of the insolvency procedures, including revision of the Law on Insolvency and bankruptcy.

The Republic of Azerbaijan has received financing from the World Bank toward the cost of the Additional Financing for Judicial Services and Smart Infrastructure Project and intends to apply part of the proceeds for consulting services. 

The objective of the assignment is to provide guidance the Ministry of Justice (MOJ) and the Governmental working group by developing a set of recommendations for the improvement of the legal framework, governing the insolvency procedures based on good international practice as well for a more efficient, reliable and transparent implementation of insolvency procedures.  

The Ministry of Justice of the Republic of Azerbaijan anticipates the assignment will require approximately 5 months of total input by the Consultant. The detailed Terms of Reference for the assignment can be obtained at the address given below.   

The Ministry of Justice of the Republic of Azerbaijan now invites eligible individual consultants to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The qualifications criteria are:   

  • Master degree in Law or higher;
  • At least five years of international experience in advising in implementing justice reforms, including contributions to reforming Insolvency Procedures; 
  • At least 10 years’ working and academic experience related to the implementation of insolvency proceedings (like e.g. as restructurer in insolvency proceedings, insolvency administrator, insolvency advisor, auditor);   
  • Familiarity with relevant international good practices related to insolvency proceedings and especially UNCITRAL;
  • Knowledge of the Azerbaijani justice system as well as experience in CIS countries is an asset;
  • Proficiency in English;
  • Excellent report writing and presentation skills.   

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” dated July 2016, revised November 2017 and August 2018 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.   

A Consultant will be selected in accordance with the Individual Consultants (IC) selection method set out in the Procurement Regulations.
